{"id":35167,"date":"2026-09-28T13:27:23","date_gmt":"2026-09-28T13:27:23","guid":{"rendered":"https:\/\/www.diningandcooking.com\/us\/35167\/"},"modified":"2026-09-28T13:27:23","modified_gmt":"2026-09-28T13:27:23","slug":"three-snowmass-village-restaurants-at-risk-of-losing-liquor-licenses","status":"publish","type":"post","link":"https:\/\/www.diningandcooking.com\/us\/35167\/","title":{"rendered":"Three Snowmass Village restaurants at risk of losing liquor licenses"},"content":{"rendered":"<p>Three restaurants in Snowmass Village were summoned before the town\u2019s Liquor Licensing Authority Wednesday on allegations of owing the town tens of thousands of dollars in delinquent sales taxes.\u00a0<\/p>\n<p>The three restaurants \u2014 Heather\u2019s, Il Poggio and The Tavern Kitchen and Bar \u2014 were given an extended deadline until September to resolve their cases before the town considers action against their liquor licenses.<\/p>\n<p>Businesses in Snowmass Village are required to collect sales taxes on taxable transactions and submit tax returns to the town. Under Colorado liquor regulations, failure to comply with tax requirements can provide grounds for a license to be suspended or revoked.\u00a0<\/p>\n<p>The town filed municipal court complaints against both businesses in July after earlier attempts to collect the debts. The Liquor Licensing Authority then ordered the restaurants to show cause why their liquor licenses should not be suspended or revoked.<\/p>\n<p>The owners of Il Poggio and The Tavern, Jeff and Ashley Moerke, did not appear at Wednesday\u2019s hearing. The two restaurants owe approximately $79,000 combined in delinquent sales taxes, penalties and interest, according to complaints filed by the town.\u00a0<\/p>\n<p>Jeff Moerke, who with his wife owns the Harper + Hudson Hospitality Group, said it was his understanding that his lawyers had resolved the issue and that it was of \u201czero seriousness\u201d to them.\u00a0<\/p>\n<p>\u201cIt was a simple oversight,\u201d he said. \u201cWe handled it within a few days.\u201d\u00a0<\/p>\n<p>But Liquor Licensing Authority\u2019s Judge Wills contradicted Jeff Moerke\u2019s statement at Wednesday\u2019s hearing.\u00a0<\/p>\n<p>\u201cThey have not shown good faith,\u201d Wills said. \u201cNot showing up today is a really bad way to start a case.\u201d<\/p>\n<p>With the Tavern\u2019s liquor license set to expire on Sept. 12, the restaurant must pay at least half of its outstanding sales taxes by that date and enter into an agreement with the town to pay the remainder by Sept. 30. If it does not meet those conditions, The Tavern will not be allowed to serve alcohol after Sept. 12, Town Clerk Megan Boucher confirmed.\u00a0<\/p>\n<p>Jeff Moerke said that the funds have already left their account.\u00a0<\/p>\n<p>Heather\u2019s owner Rene Lujan did appear at Wednesday\u2019s hearing and said he intends to work with the town to resolve the restaurant\u2019s debt. The restaurant owes approximately $34,000 in delinquent sales taxes, penalties and interest.\u00a0<\/p>\n<p>Lujan said that the town, who agreed to consider a payment plan for him, has been fair and communicative throughout the process.\u00a0<\/p>\n<p>\u201cIt\u2019s my fault,\u201d he said. \u201cWhen you collect taxes, you\u2019re supposed to pay them every month.\u201d\u00a0<\/p>\n<p>For Lujan, the case comes at a challenging time.\u00a0<\/p>\n<p class=\"has-text-align-center\">Keep up with the \u2018Mass<\/p>\n<p class=\"has-text-align-center\">Your weekly dose of Snowmass news, stories and everything happening around the village. This summer, they had a residency at The Viewline, where Lujan hoped they would have better luck.\u00a0<\/p>\n<p>\u201cI thought summer would be much better,\u201d he said, pointing to the decline in tourism this past winter. \u201cLook at the snow we had this year. The snow was bad, so our numbers were down quite a bit.\u201d\u00a0<\/p>\n<p>The threat of losing a liquor license is daunting to him, noting 30% of their sales come from alcohol.\u00a0<\/p>\n<p>\u201cYou need a liquor license,\u201d he added.\u00a0<\/p>\n<p>Cases of this nature are not common in Snowmass Village, Boucher confirmed.
