Our news partners at the Trib reported that the lawsuit was filed this week against the owners of Olives & Peppers, located at the Greensburg train station.

Allen Uhler said the owners of the establishment were negligent for allowing the conditions that led to a slip and fall outside on Dec. 27.

According to court documents obtained by the Trib, Uhler said he suspected a “white, slimy, slippery, cheese-like or food-related substance” on the ground caused him to fall outside the restaurant.

He said the incident left him in a “helpless position on the ground with both knees and top tips of sneakers touching the ground.”

The lawsuit alleges restaurant staff cleaned up the substance after Uhler first complained and failed to acknowledge it was the cause of the fall.

Uhler stated in the lawsuit obtained by our news partners that the incident occurred nearly three months after he had surgery to repair a cervical injury.

He said in the lawsuit that the fall outside Olives & Peppers has left him with worsening symptoms.

The lawsuit continued, saying Uhler claimed that after he and his wife were seated in the restaurant, he walked back outside to take pictures of the suspected ricotta-like substance. He said in court papers that he then found staff flooding the area with soap and water to remove evidence of the alleged cheese slick.

The lawsuit contends Uhler preserved the foreign substance that remained on his pants and shoes following the fall.

It is unclear what amount Uhler is seeking in damages from the establishment.
