Trafford’s licensing sub committee refused to grant the licence to the Linguine restaurant on Northenden Road in Sale.
Business owner Hevar Adbulraheem had applied for permission to sell alcohol on the premises from Monday to Thursday between 4pm and 10pm; Friday and Saturday between 4pm and 10.30pm; and on Sunday between 12.30pm and 9pm.
According to Trafford Council solicitor James Parry the restaurant is facing criminal proceedings for alleged breaches of health and safety laws at Manchester Crown Court on March 3 and 4 next year.
He said this relates to allegations that a cooker was unsafe, extraction ducting fumes had been leaked into the air and that the boiler was emitting dangerous levels of carbon monoxide.
Council documents submitted to this hearing and at previous licensing sub committee hearings said that in May last year, three members of staff were found by Home Office immigration enforcement officials to be employed without permission to be working in the UK.
Chair of the panel Cllr Sarah Haughey asked Ms Abdulraheem about access to the premises’ CCTV recordings by the police.
Cllr Haughey said it would be a condition of any licence that the police would have access to CCTV recordings for a period of at least 31 days.
However, the panel was told that the restaurant’s CCTV system only stored recordings for 21 days.
Cllr Haughey said: “The CCTV doesn’t look like it’s compliant if it’s only covering for 21 days.”
Mr Azeez said Ms Abdulraheem would ensure that it would hold 31 days’ storage in future, but accepted that currently it was ‘not compliant’.
Refusing the application, Cllr Haughey told Ms Abdulraheem: “Unfortunately, you haven’t been able to satisfy the concerns that we’ve raised previously, so we are not going to be able to grant you a licence.”
