Bad Bottle?

We’ve recently visited a winery in Tuscany and had some bottles shipped back to the US. Unfortunately, one of the bottles had a protruding cork. I’ve asked the winery about the possibility of this bottle being bad and they claim that it should be fine since there’s no stain nor smell and they would send a new bottle once I drink and confirm that it’s bad and also send the cork back to the winery.

I’ve wanted to store this for a while before consuming so that’s kind of annoying. I’ve had some protruding corks and they were bad. Should I push harder to get a return label? I think they’re hesitant to replace this bottle because of the shipping cost I guess. What’s your thoughts on this? This bottle was I think about $50~60 so not exactly cheap and I don’t want to risk it.

Do you really think 1mm of cork being above the glass indicates a completely ruined bottle of wine?
