    Expecting people to spend their time doing optional shit for the restaurant with no pay is a huge red flag. Fuck that.

    Never do *anything* for your employer off the clock. If they’re telling you to do something, you’re getting paid for it or they can fuck right off.

    Last place wanted me to handle customer complaint emails from home. Told them I’d track the time and add it to the clock. They said no, so I said no, and told them if they thought it was an issue we could talk to the labor board about it.

    Could have played the long game of clocking in taking the test and getting them for wage theft when they took the hours off. Then they would have had to reimburse everyone, but you would be stuck there. Sounds almost like a casino I worked for, briefly, with their expectations.

    I remember back when I worked at a pizza place, it would have been *empty* if they tested that crew. Even the owner used buy hash from one of the cooks.

    They drug tested the restaurant I worked at in high school. Me and one crusty old lady passed. About 85% of the staff were suspended including waitresses, bartenders, and cooks. They nearly had to permanently close their business because of it. I think they learned their lesson not to inquire about stuff they shouldn’t after that.

    MANDATORY, UNPAID drug test for fucking KITCHEN staff? Are they stupid? They may as well just shut down because there goes like 80% of your staff. The only ones left would be the felons that get tested by the state or the ones in recovery.

  19. In [ADP’s guidance](https://sbshrs.adpinfo.com/blog/drug-testing-training-rest-breaks-and-more-do-i-have-to-pay-employees-for-that) on drug testing under the US FLSA, they write:

    >”Whenever you impose special tests, requirements, or conditions that your current employees must meet, the time must be paid. This includes time they spend traveling to and from drug tests, waiting for and undergoing these tests, or meeting other requirements. Pay is required regardless of whether the tests are scheduled during the employee’s normal working hours or during non-working hours.”

    Include that screen shot in a wage theft and illegal retaliation complaint to the [US DOL Wage & Hour Division](https://www.dol.gov/agencies/whd/contact/complaints).

    No pay would have been required if it were a pre-employment drug test, or it were an optional test, but the texts make clear that it was not optional. You were simply asserting your legal right to be paid, making this [illegal retaliation](https://www.dol.gov/agencies/whd/retaliation).

    Make them fire you, you can claim unemployment then, which will give you time to find a new job and it will make their unemployment insurance costs go up.

  21. In the 15+ years of working in restaurants there was only one drug test, and it was a doozy.

    I worked at a certain Private Christian college in the cafeteria. We had an end of the year (summer break) meeting in a big conference room. It went on for like 45 minutes of just going over numbers and shit that dishwasher me didn’t care or understand at the time.

    Boss man said have a good summer, but before we go there’s one more thing… DRUG TEST FOR ERRYBODY! 🥳

    We literally lost over 20 people of the 50~ish we originally had and I just happened to clean up my act a couple months prior. It was crazy. People were crying, my boss looked at me and was like “Are you good?” “I am but we’re about to be the only dishwashers lmao” (normally we had 12 dishwashers for a full crew…)…. Rambling but yeah, that was crazy

    I took my best friend (who failed lol) to get applications before I took him home, man I can’t believe that was like 12 years ago

    I don’t know who fucking drug test cooks. I worked at a casino where they drug test, everybody but the kitchen workers.
